The special power of attorney
A special power of attorney is called a procuration spéciale in French. It grants specific powers for a clearly identified act.
For example, it may authorise a person to sign a sale, sell a specific property, accept a particular inheritance, or complete a defined legal formality.
This is the most common and safest form of power of attorney. It limits the agent’s powers strictly to the act mentioned in the document.

The general power of attorney

A translation error can unduly extend the agent’s authority. It can also restrict the agent’s powers and prevent the intended legal act from being carried out.

Apostille and legalisation: are they always required for powers of attorney?
Between France and English-speaking countries, the apostille is frequently required for powers of attorney.
France, the UK, and the USA are signatories of the Hague Convention of 1961. This convention simplifies the legalisation process between participating countries.
However, the exact requirement depends on the destination country and on the authority receiving the document. Therefore, it is always advisable to check with the notary, bank, court, or administration involved.
For English-language POAs used in France
When an English-language power of attorney is intended for use in France, the receiving French notary may require an apostille before translation.
