The special power of attorney
A special power of attorney (in French : procuration spéciale) grants specific powers for a particular act : signing a sale, selling a specific property, accepting a particular inheritance. It is the most common and safest form, as it limits the agent’s powers strictly to the indicated act.

The general power of attorney

Apostille and legalisation : are they always required for powers of attorney ?

Does the English POA need to be apostilled before translation ?
Yes, generally. For powers of attorney intended for use in France, the apostille is almost always required by the receiving French notary. It must be affixed to the English POA before translation. I recommend checking with the receiving notary.
How long is a translated power of attorney valid ?
The translation itself does not expire. However, the validity of the POA depends on its drafting date and specific clauses : some notaries require recent POAs (less than 6 months old). If expired, a new POA and a new translation will be needed.
Can I receive the certified translation only in digital format ?
Yes. Since January 2024, French sworn translations can be electronically signed with full legal value. However, many notaries in France and English-speaking countries still require the original paper version of POAs to attach to the public deed.
How is a substitution clause translated ?
The English substitution clause is translated as clause de substitution in French. The translation must accurately reflect the substitution powers granted : full, partial, conditional substitution, and any limits set by the principal.
What if the POA is handwritten or contains handwritten annotations ?
Powers of attorney are usually typewritten, but may contain handwritten annotations (signatures, initials, corrections). All such annotations must be translated and described faithfully. If the entire POA is handwritten (rare case), the translation includes a descriptive note about the document’s style.
